Terms of Service
Welcome to HoopMe. These Terms of Service ("Terms") are a binding agreement between you and AJP Studios LLC ("HoopMe," "we," "us") governing your use of the HoopMe mobile application and related services (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use HoopMe. If you are under the age of majority where you live, you may use HoopMe only with the involvement of a parent or guardian. By using the Service you represent that you meet these requirements.
2. Your account
You can start as a guest, and you may later add an email to save your account. You're responsible for activity on your account and for keeping access to your email/device secure. Provide accurate information and keep it up to date. Don't impersonate others or misrepresent your identity.
3. What HoopMe does
HoopMe helps you discover pickup basketball — view courts on a map, see activity and who's around, check in, set a status, and signal that you're "open to play," and follow other players. HoopMe is a tool for finding games; we don't organize, supervise, vet, or control users, courts, or any in-person activity.
4. User content
"User Content" means anything you submit — your profile, photos, username, statuses, availability notes, check-ins, and reports. You retain ownership of your User Content. You grant HoopMe a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your User Content solely to operate and provide the Service. You're responsible for your User Content and represent that you have the rights to share it and that it doesn't violate these Terms or any law or third-party right.
5. Acceptable use — zero tolerance for objectionable content and abuse
You agree not to post, upload, or engage in any of the following:
- Sexually explicit, pornographic, or nude content
- Violent, gory, or graphic content, or content that promotes self-harm
- Harassment, bullying, threats, hate speech, or content that demeans or attacks people based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Illegal content, or content that promotes illegal or dangerous activity
- Spam, scams, fraud, or deceptive behavior
- Impersonation, or sharing another person's private information without consent
- Photos that are not a genuine representation of you or that contain other people without their consent
- Interfering with, scraping, reverse-engineering, overloading, or attempting to gain unauthorized access to the Service
6. Moderation, reporting, and blocking
To keep the community safe, we provide tools to report objectionable content or abusive users and to block other users. Uploaded profile photos are automatically screened for prohibited content. We review reports and will take appropriate action — typically within 24 hours — which may include removing content, and suspending or terminating the accounts of users who violate these Terms or post objectionable content. We may remove content or restrict accounts at our discretion to protect the community.
7. Meeting other people and physical activity — assumption of risk
We do not perform background checks on users, verify identities, or vet courts or conditions. You are solely responsible for your own safety and decisions. Meet in public, use good judgment, and stop if you feel unsafe. Basketball and related physical activity involve risk of injury; you participate voluntarily and at your own risk. To the fullest extent permitted by law, you assume all risks arising from your use of the Service, including any in-person interactions, travel to or from courts, and athletic activity, and you release HoopMe from any resulting claims.
8. Third-party services
The Service relies on third parties (including Apple, our backend provider Supabase, and our image-moderation provider Sightengine). Your use may also be subject to their terms. We're not responsible for third-party services we don't control.
9. Termination
You may stop using HoopMe and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms, create risk or legal exposure, or if we discontinue the Service. Sections that by their nature should survive termination (including content licenses already used, disclaimers, limitations of liability, and indemnification) will survive.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't warrant that the Service will be uninterrupted, error-free, accurate, or that court information, headcounts, or user activity are reliable.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HOOPME AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, INJURY, OR HARM ARISING FROM IN-PERSON INTERACTIONS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless HoopMe and its owners from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, your interactions with other users, or your violation of these Terms or any law or third-party right.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where prohibited by law.
14. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date and, for material changes, provide additional notice in the app where appropriate. Continued use after changes means you accept the updated Terms.
15. Apple App Store
If you download HoopMe from the Apple App Store, the following apply: these Terms are between you and HoopMe only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. Apple is not responsible for any product warranties or for addressing any claims relating to the app (including product liability, legal/regulatory compliance, or intellectual-property claims). You agree to comply with applicable third-party terms (e.g., your wireless data plan) and represent that you are not located in a U.S.-embargoed country or on a prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
